February's Newsletter

I received the newsletter and other documents. "Thanks".
The newsletter is really good and it's informational. Again, thanks.

Despite my...attacks. I need to let everyone know I do support George and his members. I do and always will harbor a distrust and low opinion of the Beaman council. I just think someone should be critical and some times...aggressive. It happens to be the way I am.

Drive on.

Forum: archive

Casino

Every year Indian Gaming becomes more regulated. It gets harder every day to have land taken into trust. The day is coming when Indian Casinos won't be allowed to be built.
This Supreme Court ruling from yesterday is case in point.

http://www.washingtonpost.com/wp-dyn/content/article/2009/02/24/AR2009022401323.html

With the wording of the Timbisha Homeland Act, I think we still have a chance...... if we hurry

Forum: archive

feb. rstf checks out!

Okay, our attorneys filed a temporary restraining order request with the court for the CGCC to hold the rstf checks until BIA makes a decision. The judge denied the request saying we should look for other avenues to prevent the check from going out. However, the request was heard Monday or Tuesday. I called the CGCC and they told me the checks would go out Thursday or Friday. This means there was really no time left to do anything else. So, the checks will be sent to Death Valley, the last address given to the CGCC. Despite this disappointing decision, there is one thing in our favor, the check is from the 2008 fourth quarter, which includes the months of October, November and December.
Some members of our tribe received letters in mid November stating their enrollment was in question and had a ceratin amount of days to reply. Some time later, late December or early January, approximately 72 members received dis-enrollment letters. This clearly means ALL TIMBISHA MEMBERS enrolled in the tribe during October, November and December, and who in reality still are, should receive their checks. Maybe Joe will learn how to count before the checks go out, if not he will be misappropriating funds!

Forum: archive

Yo George, You claim fiscal improprieties against Joe, so I was wondering if you had actual evidence of these crimes. I want to back you 100% but I can't if the evidence is merely hearsay. If crimes were committed would bringing in the police or F.B.I. violate our sovernity?

Forum: archive

Constitution: enumerated powers

It's probably too late to bring it up now and I'm sure at some point in the past it's been addressed but with the possibility of a new administration and the implementing of a Judaical system; as a member the enumerated powers of the tribal council doesn't seem to have any over-sight or there doesn't seem to be some sort of checks and balances before any deals are struck.
I know the General Council has a final vote but I'd like to see some provision to guarantee a conference with General Council before the Tribal Council enacts decisions they make on their own behind closed doors in the name of the tribe.

My reasons are: the decision of Ed Beaman, Ginger Beck, Ellie Jackson to halt the going forward with the Casino funded by Fears after General Council voted to proceed and of course I have to throw myself in with that bunch as well (bad decision).

The decision of Ed Beaman, Ginger Beck, and Ellie Jackson to invest the Children's Trust Fund after General Council voted to leave that money alone.

The conflict of interest allowed by Ed Beaman, Ginger Beck, Lyle Casey and Joe Kennedy to employ Ellie's son Erine to oversee the handling of the Trust Fund as an investment.

I think the Constitution as is gives the tribal council too much leverage to go off on their own without General Council over site or approval on behalf of the tribe without majority concurrence of General Council.

Forum: archive

George's Casino Update

It just seems like we're in quagmire of bureaucratic BS that has no ending. Our attempts are equivalent to a moth trapped in a bucket of water fluttering around in circles trying to escape. Isn't there any thing that can be done that would just cut through all the crap and finalize all this once and for all? The BIA is just going back and forth; back and forth with recognition then non-recognition, recognition then non-recognition. I'm beginning the think the BIA is made up of Indians.

What about an open, immediate, debate before the BIA between Joe and George with each presenting their facts and proof to end it all and get on with it? I'm confident that George will win. I know George would win because George is right- Joe is wrong! Joe may have this Shapiro behind him but he's wrong. When the BIA sees how Joe went out of his way to halt the advancement of the tribe George will win. That's my take and although I'm speaking out of anger- I feel I'm right about this. (My opinion and I'm just asking a question).

Forum: archive

Joe is at it again

JOE has filed a lawsuit against the BIA. It is about 35 pages long. It list Joe, Pauline and Madeline as the plantiff representing the Timbisha Shoshone Tribe.

Everyone knows the trouble we have had with the BIA making one decision and then changing it and on and on. The investors started to move forward when we got the first letter from the BIA then the second letter came out giving Joe the 30 days so plans came to a halt. Now that George is recognized as the chairman they have started moving forward. They are going to fast track everything they can. Grish and Greg are going to everything they can to hold up thier side of the deal. These gentlemen accually care about tribal members unlike other investors. The gaming committee is going to set up a date to sit down and talk to the investor and hopefully meet thier entire team that will be working on the casino. We will keep you up to date on how the project is going.

Forum: archive

Dis-enrollment

There have been several people that received letters from the enrollment committee. I think that the enrollment committee should read all of the information that pertains to enrollment. People that hold a position on a committee should know what they are doing.

I have learned some information about the base roll. There was a money distribution in California. There was a list made of the people that received that money. Pauline took that list of names and removed the people that she didn't want on there and called it the base roll. The base roll was not a census. The base roll had more names on it and the other names were taken off. In the application for recognition the 1933 and 1936 census was used. These census rolls were conducted by the government. The 1978 base roll was done by Pauline. The rumor is that in 1988 when the amendment to the enrollment ordinance was created that Pauline was very angry about it listing the people on the 1936 census. The push for the division in the tribe goes way back and I don't know why. Some of the people in the village live off the money from the tribe. Some of the tribal member in the village live on the money they get for going to meetings and being on committees. I think that if one of the people in the village are making money off of the tribe all of the members living in the village should have the same opportunity. I wonder if they do? The village was set up for 50 homes. I think that anyone who wants to live in the village should be able to.

I will write more later.

Forum: archive

Joe's wife kicks members out!

Ok people, patricia kennedy, madeline frank n grace goad (the enrollment committee) conducted their "annual" meeting and concluded much of us are no longer members. If u haven't already received your disenrollment letters, U will. And that means no more rstf money either. Sorry about christmas. Of course, this is all a game to get joe and his wife one last chunk of money since his ship is sinking fast, but it does hurt our people. What else is new? So, what we can do is flood the bia with letters n phone calls

Just a note Madeline Frank is not on the enrollment committee nor did she have anything to do with the dis-enrollment letters. The person on the enrollment committee is Amilia Frank. GDG

Forum: archive
